2. What data we process, why and on what legal basis
This website has no registration forms or user accounts. We process personal data only in the following cases:
- Enquiries and bookings by phone or WhatsApp: we process your name, phone number and booking details (date, time, number of guests and comments) to handle your enquiry or booking. Legal basis: pre-contractual measures at your request and, where applicable, your consent (Art. 6.1.b and 6.1.a GDPR).
- Bookings through TheFork: the data you enter on that platform is processed by TheFork as controller, under its own privacy policy. We receive the booking details to look after you (Art. 6.1.b GDPR).
- Browsing the site: we do not use analytics or advertising cookies. The server hosting the website may log technical data (IP address, date and time, pages visited) for security and operation, based on our legitimate interest (Art. 6.1.f GDPR).
- Google map: it only loads if you request it; see the Cookie policy.
3. Recipients
We do not disclose your data to third parties except where legally required. To provide the service, providers that access data as processors or independent controllers are involved: the web hosting provider, WhatsApp (Meta Platforms Ireland Ltd.) when you contact us that way, TheFork when you book on its platform, and Google when you load the map. Some of them may process data outside the European Economic Area with the safeguards provided by the GDPR (such as standard contractual clauses or the EU-US Data Privacy Framework).
4. Retention period
We keep enquiry and booking data for as long as necessary to handle them and, afterwards, blocked for the legal limitation periods for possible liabilities. Server technical logs are kept for the period set by the hosting provider, which is normally limited.
5. Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent at any time, by writing to info@restauranteesturion.com or by post to Av. de Panamá, 03502 Benidorm, Alicante, stating the right you wish to exercise and attaching a copy of your ID.
If you believe we have not processed your data in accordance with the regulations, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
6. Minors
This site is not aimed at children under 14. If you are a minor, ask your parent or guardian to handle any enquiry or booking for you.
7. Security and accuracy of data
We apply reasonable technical and organisational measures to protect data. Users guarantee that the data they provide is accurate and undertake to notify any changes.
